1. Acceptance
These Terms of Service apply when you visit Imaginoix, play a game hosted here, or otherwise use this website. By using the site, you agree to these terms. If you do not agree, please do not use the site.
2. The games and site
Imaginoix provides free browser games, technical demonstrations, portfolio material, and educational class resources. Access is offered without a personal user account, although an EDU group may require a shared class password, and may change, pause, or end at any time. The site, games, and teaching materials are provided “as is” and “as available.”
3. Intellectual property
Unless a page says otherwise, the site, games, code, artwork, audio, writing, trademarks, and downloadable build files are owned by Hector Magaña / Imaginoix or used with permission. You may play the games for personal, non-commercial entertainment. You may not copy, reverse engineer, redistribute, sell, sublicense, rehost, or make another service from the site or its game build files, except where applicable law gives you a right that cannot be limited by these terms.
4. Acceptable use
Please do not misuse Imaginoix. In particular, do not:
- scrape or automatically harvest the site in a way that burdens the service;
- attack, disrupt, overload, probe, or introduce malicious code to the site or its hosting;
- bypass access controls, attempt to enter restricted or non-public areas, or access files that are not publicly linked;
- distort analytics through automated, deceptive, or repeated artificial traffic; or
- use the site in a way that violates law or another person’s rights.
5. Limited EDU submissions
Imaginoix does not accept public uploads, comments, or visitor accounts. A student using an assigned EDU test may submit their name and answers for timing, grading, and class review. Students must use their own name, submit their own work, and must not interfere with another student’s attempt or private result link. Test responses are not published publicly. If you email Hector, that message is handled as ordinary correspondence and is not published as site content.
6. Third-party links and embedded services
The site may link to or embed third-party websites or services, including privacy-enhanced YouTube players. Those services are controlled by their operators, not Imaginoix. A link or embed does not mean Imaginoix endorses or guarantees the third party, and their own terms and privacy practices apply.
7. Compatibility and warranties
Browser games depend on WebGL, JavaScript, graphics drivers, browser capabilities, device resources, and network conditions. A game may not load or perform correctly on every device. To the fullest extent permitted by law, Imaginoix disclaims express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, availability, security, and error-free operation.
Some games may save preferences or progress only in your browser. Clearing browser data, using private-browsing features, changing browsers or devices, or browser storage restrictions may erase or prevent those local saves, and Imaginoix cannot restore them.
8. Limitation of liability
To the fullest extent permitted by law, Hector Magaña and Imaginoix will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost data, profits, opportunities, or device compatibility issues arising from use of—or inability to use—the site or a WebGL game. Where liability cannot legally be excluded, it is limited to the smallest amount the law permits. Nothing here excludes rights or liability that applicable law says cannot be excluded.
9. Privacy
The Privacy Policy explains the limited, cookieless analytics, the necessary EDU access and live-game cookies, EDU test names, answers and grades, embedded YouTube players, and the data the service does and does not keep.
10. Changes
These terms may be updated when the site, games, or legal requirements change. The date at the top shows the latest version. Continuing to use the site after an update means the new terms apply from that point forward.
11. Governing law
These terms are governed by the laws of Mexico, without regard to conflict-of-law rules. Any mandatory consumer protections that apply to you remain unaffected.
